Date: September 24, 1996 Subj: Report of Director's Decision Regarding a Minor Modification Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. Plan for both the enclosure of 355 square feet of existing deck space to enlarge the dining room and the placement of a SOKW emergency power generator adjacent to existing pump house. Description Attached site plan and vicinity map (Figure 1), shows the location of both the enclosed deck space and the emergency power generator. The main floor plan (Figure 2) shows the location of the dining room enclosure. Attached is Exhibit A, a letter from the applicant stating their reasoning for both the deck enclosure and the emergency power generator. The applicant wants to enclose the space because the present deck is being under utilized and it would be more efficient for as part of an increased dining room. While an increased number of power outages over the past two years is the reason why the applicant wants to install an emergency power generator. Also attached with this report is Exhibit B from the applicant detailing power outages in the area over the past two years. Figure 3 shows the exterior elevations and cross sections for the site. Staff has no problem with either request. The enclosed deck is not visible from neighboring properties. The new generator is not audible to any surrounding properties, as evidenced by the enclosed noise exception approved by Cupertino's Noise Control Officer (Exhibit C). Action The Director of Community Development approves the addition of the existing deck space and the placement of the emergency power generator according to the plans provided. Enclosure of Exists Deck Over the past several years, there has been minimal use of the existing deck which is to be enclosed. If the weather is nice enough to be outside, the retirees use the easterly deck since it has a better vista. Conversely, the dining room is in continual use. It is proposed that the expanded dining room would allow the placement of smaller tables which would facilitate not • only a diminished institutional mealtime atmosphere and experience but would enable a erecter separation of the room for recreational activities. Emer~ncy Generator: The Villa currently has an emergency power generator for power and for providing electricity to the pumps that support the fire sprinkler system. This system, however, is not capable of supporting the pumps that boost the domestic water from the main to the facilities. To enable the Villa to be fully operational in the event of a power failure, the water system requires a separate generator. Since 1993, a record of power outages has been recorded which is enclosed for your information. It is proposed to place the new senerator on an existing concrete pad adjacent to and westerly of the existing pump house. At that location, it will not be visible from the public terminus of Mercedes Road and it wilt be afforded the shielding of the structure. It is expected that the large existing generator will greatly mask the new generator noise so that there will be no perceptible change in the "ambient power outage" noise level. Doting our site visit last week, you indicated that once the Application is approved, a Building Permic must be issued within two years. We wish to confirm this time period because the fund raising effort for the enclosure portion of the project may take as long as twenty months.
