Subj: Report of Director's Decision Regarding a Minor Modification
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner
to appeal the decision within fourteen calendar days.
Application: _ U-94(M) Minor modifications to an approved plan for 120 "for rent"
condominium units, Cupertino City Center, southeast quadrant of Stevens Creek Boulevard and
DeAnza Boulevazd.
Descrjp~ion
Three modifications aze proposed, due to differences between the approved plans and building
permit plans:
The approved plans indicate 106,900 sq. ft. of building area. (See approved plan Page 1.)
Building permit plans indicate 112,738 sq. ft. The reason for this discrepancy is that project data
as reported on the approved plans (page I) was incorrect; the square footage was I (2,738 at that
time. Inreases in unit size (approximatelly 50 sq. ft. per unit type) were already reflected in the
building footprint. No change in building footprint from the approved to the building plans has
occurred. The new unit sizes are shown on pages A4.1-.4
:~ spa is shown on the approved plan (page 3), but is eliminated in the building plans. 'T'his
decision was made due to experiences at other developments where people in units close to the
spa are disturbed by the noise. Retaining the spa is not required in order to maintain the acreage
needed for park credit. The project's opegspace demand is 1.18 acres and the open space
provided is 1.6 acres, which includes a spa in the common pool area,

A condition of approval states: "The developer shall provide a minimum of 1.8 spaces per unit.
The developer shall work with planning department staff to add additional parking spaces in the
garage. The gazage parking spaces shall be designated for each unit."
Parking spaces for approved and building permit plans are:

The building permit ratio is met, but the gazage spaces have decreased. This is due to the
expansion of the health center and inclusion of numerous mechanical structures. (See page 2 0l'
the approved plans and A2.0 of the building permit plans.)
Staff worked with the developer to increase garage parking, but the negative aspects of adding
spaces outweighed the benefits, e.g., closirig off anaisle-way, creating tandem parking.
The developer is able to add 9 on-grade spaces, for a total of 228 spaces and. a ratio of 1.9 spaces
per unit. This exceeds the condition of approval ratio. Given the lack of flexibility to add spaces
in the gazage, staff supports the proposed parking.
