Director's Decision Regarding Minor Modification
/ Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval
of minor changes in a project. The Director reports his decision to the City Council
and Planning Commission in time to allow any Councilmember of Planning
Commissioner to appeal the decision within fourteen calendar days.

Description
The applicant proposes a modification to the approved site plan for a 201 unit apartment complex
t6 move the footprint of Building 7, on Podium B, approximately 10 ft. easterly from the
approved site plan. The change in footprint is shown on Sheet 1. The modification was shown
on previous plans, i.e., landscaping approval and entry modification to Building A, but was not
called to the attention of the staff or the Commission, and was not explicitly approved. The
approved setback from Linnet Lane is 71 ft. 11 in. The proposed setback is 82 ft. 4 in. The
setback from the curb along the private access road in front of the apartments is 10ft. closer than
the approved setback. As shown in the applicant's letter, the reason for changing the location of
this building is to create a more balanced design.
Staff approves this change, because the building is still set back a significant amount from the
roadway, and the setback does improve the relationship to the residents to the west. The ratio of
height to setback from the private road still exceeds a 1: 1 ratio.
Please note there are minor design changes on Elevation Sheet 2, as well as other minor changes
which will be coming back to Planning Commission for further review. However, due to the
construction schedule, the applicant seeks immediate approval of the shift of building footprint
prior to additional review by the Planning Commission.
Action
The Director of Community Development deems the modification minor and approves the
setbacks.
