Date: November 5, 1997 Subject: Director's Decision Regarding Minor Modification Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes to a project. The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision with fourteen calendar days. Description Installation of and awning and drop curtains in the rear outside patio ofHobee's Restaurant, Oaks Shopping Center. Discussion Hobee's Restaurant proposes to install an awning and drop curtains in the rear outside patio. They will be made of green canvas. The patio is currently used for outside seating, and the cur- tains will allow for year-round use. The Oaks Shopping Center is allocated a maximum 880 restaurant seats, including outside seat- ing. The center is well below the allowed maximum with 752 seats. The proposed curtains were reviewed by the fire and building departments, which provided comments that can be resolved at the building permit stage. Recommendation Since there are no problems or impacts with the proposal, staff recommends approval. Evans Hobee's DeAnza The Oaks Shopplng Center 21267 Stevens Creek Blvd., Suite 310 CUpertino, CA 95014 408.255.6010 To: Ciddy Wordell City Planner, Cupertino Re: Hobee's Restaurant Awning and Patio Drop-Curtain Addition Hobee's DeAnza Restaurant would like to construct an awning and drop-autain structure to enclose its outdoor patio seating area during the colder winter months. The awning would follow the existing roof-line, mounted to the underside. It would be constructed of black aluminum tubing, covered with a dark green Firesist fire-retarding fabric with large clear plastic windows sewn in to them. The curtains would be rolled up or down, depending on the weather, using rope and pulley equipment. The curtains would fasten together at the sides with sewn-in velcro strips. The curtains would hang down directly outside the existing patio railing, enclosing the patio at the exact limit of the patio terrace. The two exit areas would be treated as follows: The end facing Stevens Creek Boulevard would have a drop curtain attached at the top with rings on a steel cable stretching the lengh of the curtain, similar to a shower curtain. The end of this curtain would have a large white "EXIT' sign printed on it with an arrow marked "PULL". The curtain would be pulled back easily, just as a shower curtain is, and the exit open directly through the existing patio railing. The opposite end of the patio would have a panel of the same Firesist material instead of a drop curtain. In the middle of the panel would be a standard 36" patio screen door which would swing in both directions for easy entrance and exit. It also will have a large white "EXIT' sign printed on it. It is anticipated that most of the year the curtains will remain in the up position.
