The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision APPLICATION Minor modification of a landscaping plan for Application No. 11-U-96 (Mod.), Symantec, Inc., Cupertino City Center. DESCRIPTION The landscape architect sought approval to change the approved landscaping plans. Please refer to the index map to locate the changes. The changes are described as follows: 1. Removal of three trees located near the southeast comer of the building. The engineer/architect determined that the structural slab, which also is the ceiling of the upper most level of the parking garage, should be sloped to allow drainage. This effort results in a more shallow planting bed near the center of the site and there will not be adequate depth to support the three trees. There is adequate depth to support the fourteen plum trees which will surround the sand/volleyball court. 2. Removal of existing aristocrat pear trees on DeAnza Boulevard. The approved landscaping plan retains the existing pear trees and proposed two rows of 24 in. box trees along the frontage. This plan will result in significant differences of height between the existing tees and the proposed 24 in. boxed trees. The applicant's proposal is to remove the ten year old pears trees and install three rows of 36 in. box pear trees. The removal of trees and the replacement of 24 in. box trees with 36 in. box trees represents a significant increase in the cost of the project. Thus, the applicant is not motivated by cost saving but rather by obtaining consistency in the tree planting. The Public Works Director and I agree that the applicant's plan will result in a more pleasing appearance. (The trees are in the public right-of-way.) 3. Change plant materials used for the main hedge along DeAnza Boulevard and internal hedges. The change on De Anza Boulevard from Ligustrum to Prunus Lusitanica will result in plants with larger and darker color foliage for the hedge. The landscape architect would also like to replace the Rhaphlolepis hedges with hedges of Myrsine and Phormium because it would result in a more interesting, contrasting appearance in the bands of lawn and ground cover. Neither the Planning Commission or City Council focused much attention on the use of the plant material for the various hedges and stat! deferred to the judgment of the landscape architect. 4. The sidewalk which connects the south end of the building to the diagonal walkwav leading to the sand/vollevball court was extended. This was necessary for both fire existing and to give employees better access to the recreation facility. ACTION The Director of Community Development deems the proposed modification is minor and approves the change. Approval is effective October 24, 1997. Please call me if you have a question regarding the changes. The Planning Commission and the City Council have a fourteen day period to appeal. The appeal period expires on November 7, 1997.
