The Director reports his decision to the City Council and Planning Commission in time to allow a Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. Application: Application No. 6-U-76(minor mod.), John Mc Guigan, 10163 Miner Place Background: In 1976 BAS Homes received approval to rezone 8.6 acres from RI-I0 and R3-2.2 to peRl) and construct 39 single family homes. The intent of the P(R1) zoning was that the homes in the development would comply with the R1 ordinance. However, in 1988 the R1 ordinance was amended to institute a maximum floor area ratio (FAR) of 45%. Prior to the amendment of the R1 ordinance, several of the homeowners took advantage of the architectural features of the homes by converting existing attic space to living space. Many of the homes are single story with steeply pitched roofs allowing an opportunity for attic space to be easily converted to living space with minimal exterior modifications to the home. These conversions resulted in F ARs in excess of 45%. Description: The applicant is seeking approval to exceed the 45% FAR that his property is now subject to. The plans call for converting 367 square feet of attic to living space. In addition, 56 square feet will be added to the first floor to accommodate a stairwell. The resulting FAR will be 47%. Action: Since the conversion of the attic space will result in only minor exterior modifications to the home, the Director of Community Development approves the minor modification allowing the applicant to exceed the 45% maximum floor area ratio.
