Subj: Minor Modification of 2-U-97 to allow two windows on the side of an existing
restaurant and the erection of a 6-foot fence on the side property line. 10700 S. De Anza

Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application:
Minor Modification of 2-U-97 to allow two windows on the side of an existing
restaurant and the erection of a 6-foot fence on the side property line.
Description:
The applicant, Fumio Suda, received approval from the Planning Commission to expand
and renovate "Paul's Restaurant" on April 28, 1997. The applicant is requesting
additional minor changes to improve the dining environment and operation of the
restaurant. The request is for one large pane of glass on the south side of the building to
provide additional natural lighting for customers and a smaller window for the restaurant
office (See sheet A-5 ofthe plan set). Because the view from the larger window would
overlook the adjacent Taco Bell driveway, the applicant requests the erection of a 6-foot
property line redwood fence to screen the view. This fence will not extend pass the front
building line. Existing Taco Bell1andscaping and site landscaping will screen the fence
from the street.
Action:
The Director of Community Development deems the modification minor and approves
the two windows and section offence. The approval of the modification is effective
September 5, 1997. The fourteen calendar day appeal period will expire on September
19, 1997.
