Subj: Report of Director's Decision Regarding a Minor Modification
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner
to appeal the decision within fourteen calendar days.

Application No. 22-U-67 (Minor Mod.), Glenbrook Apartments, 10100 Mary Avenue. Application to
remove existing 4 ft. tall chain-link existing fences and replace fence with a 6 ft. tall chain-link fence
painted dark forest green.
Description
The application involves a fence design issue involving the common property line between the
Glenbrook Apartments and Memorial Park. The Glenbrook Apartments is zoned Planned
Development. Please refer to Exhibit A for a description of the location of the proposed fence line.
The applicant's request is to replace an existing 4 ft. high chain-link fence topped with barbed wire
with a new 6 ft. high chain-link fence which will be painted forest green.
The original 1967 use permit drawings (see attached) depicts a 3 ft. high split rail fence. The record
does not contain information which authorizes the switch from the approved split rail fence to the
current 4 ft. high chain-link with batbed wire. The original plan also had proposed an opening between
Glenbrook and Memorial Park which has since been closed. Given the need of both the City and
Glenbrook to control access, it is easy to understand why the 3 ft. high split rail was switched to a
chain-link at some point in the past.
Action
The Public Works Director and Par~s and Recreation Director support the new fence, particularly
given the fact that the barbed wire fence is a dangerous situation. Therefore, I have approved the minor
modification to the original use permit to utilize the 6 ft high chain-link fence painted forest green in
the area so shown on Exhibit A.
