Subj: Minor Modification of 10-ASA-95 to move the location of a required retaining
wall outside of a 10-foot utilities easement for 11703 Dorothy Anne Way (Applicant:
Ehud Gordon)
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application:
Minor Modification of 10-ASA-95 to move the location of a required retaining wall
outside of a 10-foot utilities easement for 11703 Dorothy Anne Way (Applicant: Ehud
Gordon)
Description:
The applicant, Ehud Gordon, is proposing to relocate an approved but unbuilt front
property line retaining wall 10 feet from the street, outside of a public utilities easement.
The retaining wall was proposed by the applicant's geotechnical consultant and
recommended by the City Geologist in order to maintain the stability of the sloping
property which was approved for residential development by the City Council on June
17, 1996., The retaining wall was approved in the utilities easement for two reasons:
1) staff felt the easement could be vacated because of the absence of City utilities, and
2) the wall would be taller and more visible upslope. In the utilities easement at the base
of the hill the retaining wall would be 3-foot tall. Just outside of the easement, the wall
would have been at least 5 feet tall.
The applicant has been unable to obtain a vacation of the easement in order to build the
retaining wall. While City staff has been agreeable to the vacation, the applicant could
not obtain approval from other utility companies that had an interest in the easement.
The retaining wall is thus proposed for relocation outside of the easement and the
retaining wall. Exhibit C shows the approved fence/retaining wall at the front property
line and the proposed fence/retaining wall which has the same dimensions, except for
narrower columns.
The City Geologist has reviewed the change in the retaining wall location and had no
comments.
Action:
The Director of Community Development deems the modification minor and approves
the retaining wall relocation just outside of the public utilities easement.
This approval ofthe modification is effective April 18, 1997. The fourteen calendar day
appeal period will expire on May 2, 1997.
