Subj: Report of Director's Decision Regarding a Minor Modification
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow Counci1member or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application
Application No. 3-ASA-97 (Minor Mod.), Bruce Fowler, Marketshare, Citation Homes,
Southeast corner of Homestead Road and De Anza Boulevard.
Background
In October 1995, the construction of a three story, 140-unit apartment complex was approved.
The project is currently under construction. Condition No. 15 (signage) of that approval required
Architectural and Site Approval of all signage visible from the public roadway. On March 10,
1997, the Planning Commission approved the visible signage (Resolution No. 4825).
Description The minor modification request is for a change in color scheme. The proposal is to
replace the approved beige stucco sign base and body and gold colors in the tile with the
approved apartment colors of spice beige and terrawood which is the colors being applied to the
main apartment building. The color board approved for the apartment building is available in the
Planning Department, and the Planning Commission approved sign colors.
Action
The Director of Community Development approves the minor modification subject to the sign
colors matching the approved material board for the apartment complex.

SECTION II: FINDINGS
WHEREAS, the Planning Commission of the City of Cupertino received an application to fulfill
condition #15 of City Council Action letter dated October 20, 1995; and
WHEREAS, the Planning Commission finds that the signage is consistent with the sign ordinance; and
WHEREAS, along with the conditions of approval, the signage is consistent with the approved
building form and color.
NOW, THEREFORE, BE IT RESOLVED:
After careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this
matter, the signage described above concerning Application 3-ASA-97 set forth in the Minutes of the
Planning Commission meeting of March 10, 1997, and are incorporated by reference as though fully
set forth herein.
SECTION III: CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT DEPT.

The recommendation of approval is based on the following exhibits and as modified by the

2. ILLUMINATION RESTRICTIONS
The applicant shall provide proof with the building permit drawings that the internal lighting um:s
not exceed one hundred foot-Iamberts (17.24.190).
3. LOCATION
The applicant shall provide proof with the building permit drawings that the monument sign
location is not located within the corner triangle or sidewalk site triangle (17.24. 120). .
4. MATERIAL BOARD
The color PMS 327 (Teal) is not approved. This color shall be replaced with the approved green
accent color (5545A) of application 8-U-94.
5. BUILDING IDENTIFICATION SIGN
The printed border shall be replaced with 6"x6" porcelain tile as approved on the material board.
6. DIRECTORY SIGN
The sign is limited to a map of the project and an arrow indicating "you are here." No tenunt names
or apartment numbers are approved.
