Report of Director's Decision Regarding a Minor Modification

Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application
39-U-83(M) minor amendment to an existing commercial center, consisting of
installation of a roll-up door at the rear entrance of one tenant.
Description
A new tenant in the DeAnza Center has begun installation of a steel, roll-up door at the
rear entrance ofthe retail space highlighted area on Exhibit A, site plan. A minor
amendment is required to approve the door.
Business activity at this center has been reviewed by the City in the past. Recent
revisions to the General Commercial ordinance related to this site resulted in a provision
requiring a use permit for commercial uses which incorporate contracting services. A use
permit was issued for the Plumbing Bank in this space, but is not required for this tenant
since it is a retail, and not a contracting, use. Recently 12-14' masonry walls, which are
higher than most walls required in this situation, were installed at the rear property line to
mitigate the noise between the center and the adjacent residences.
The above-referenced General Commercial ordinance and noise ordinance are designed to
control the uses and activities in the city's commercial areas. StafT supports the
application because the proposed retail use is a permitted use. Any number of retail uses,
such as furniture stores, could require loading doors for deliveries.

The Director of Community Development approves the amendment.
