Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application:
Modification to the "Gate 5" security access to the Hewlett Packard site from Homestead Road.
Description:
With reference to the attached plan sheet labeled L 1-0 dated October 21, 1999 you wi II note that
the upper left-hand panel describes the drawings as approved by the Planning Commission July
1999. The approved plan modifies the existing gate to provide a turn-around loop. The new
proposal is to eliminate the loop, which would eliminate the reduction of parking spaces and the
removal of at least two ash trees. The security operation would remain the same. I r a person can
not get access via the card reader or could not gain access following a call to the security
department, the single access barrier gates would raise and the person would have to make a LJ-
turn in the 38" wide street. While this appears awkward, in reality the security gate system
operates late in the evening and therefore the traffic entering out of the 1-11> 1~lcility is extremely
light. The upper right hand panel describes the proposed revision. As indicated in the attached
letter from JoDee DeVries, Project Manager, large trucks that don't gain access would follow the
same procedure as would have been followed had the approved project been installed. Trucks
would enter into the site and make a turn-around near the terminus of the access drive under the
scrutiny of the on-site security guard.
Action:
The proposed revision saves trees and does not result in any external traffic conflicts fix the City.
The revision does require a more awkward turning movement in the sense that a car would have
to make a turn that is similar to that which would be made on a 3X" wide public street.
Depending upon the turning radius of the vehicle, there might be some slight jockeying to make
the turn. Given the late hours of operation this does not create a problem. Therefore the project
is approved contingent upon the conditions of approval that were imposed in July of 1999 (copy
attached). An individual Councilmember or Planning Commissioner has the ability to appeal
within 14 calendar days. If the staff report or drawings are unclear, please do not hesitate to call
me.
This approval is effective October 23, 1999. The fourteen-calendar day appeal will expire Oil
November 6, 1999.
