Subj: Modification to 6-U-97 and 4-TM-97, the Oak Valley development. The applicant
is The O'Brien Group. The property is located south of 1-280 and west of Foothill Blvd.
and Rancho San Antonio County Park and Stevens Creek Blvd.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes to a project. The Director reports his decision to
the City Council and Planning Commission in time to allow any
Councilmember or Planning Commissioner to appeal the decision within
fourteen calendar days.

Description:
Condition 7 of6-U-97 and condition 16 of4-TM-97 require that the open fencing be
painted a dark flat paint. The applicant is requesting that the fencing remain unpainted.
They believe that the painted fencing would be more visible than the natural weathering
of the wire fence, and that it would present a future maintenance problem.
An example ofthe natural wire fencing without paint exists at the Sunset Idea house.
Staff believes that this unpainted fencing appears fairly invisible and would not present
any negative visual impacts if used on the various wire open perimeter fencing as
required. Staff also agrees that future maintenance of painted fences could be a problem.
Action:
The Director approves the modification of changing the open wire fencing from dark flat
paint to natural wire.
