area, entrance and bathrooms for the Marie Callender's Restaurant at 20750 Stevens

Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application:
Minor Modification for handicapped accessibility improvements to the parking area,
entrance and bathrooms for the Marie Callender's Restaurant at 20150 Stevens Creek
Boulevard.
Description:
The applicant, Nuttall Uchizono Associates, is proposing to expand the Marie Callender
Restaurant bathrooms to meet current federal ADA (American Disabilities Aet)
requirements. In addition, the applicant plans to move the handicapped parking and
entrance to the front of the restaurant. Currently, handicapped patrons must enter the
restaurant from the rear, which is accessible, and traverse the entire restaurant before
reaching the front lobby.
These improvements involve the partial removal of an unused truck ramp and land
scaped planter box to make room for two handicapped parking stalls and a wheelchair
ramp. The bathrooms need to be expanded 52 square feet which will occur under and
slightly beyond the existing eave line ofthe roof. The portion that juts out slightly will
not be very visible because of a jog in the existing building behind the addition. Current
trash loading areas and restaurant seating will not be affected by these improvements.
The partial removal of the truck ramp and planter box will necessitate landscape
improvements. A landscape plan was not submitted. StatT is conditioning approval on an
acceptable landscape plan to be approved by the Director.
Action:
The Director of Community Development deems the improvements minor and approves
the handicapped accessibility improvements contingent upon the submittal of an
acceptable landscape plan for the affected area. This approval of the Modification is
effective August 30, 1999. The fourteen calendar day appeal period will expire on
September 13, 1999.
