Date: August 18, 1999 Subj: Report of Director's Decision Regarding a Minor Modification Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. Application Modification of Condition 18 of Use Permit Application No. 6-U-97, O'Brien Group (Diocese of San Jose) to allow a 2x4 opening wire fence rather 4x4 opening wire fence. Discussion Condition 18 of the Use Permit specifies that adjacent to development Area 1 (Area B) on the attached site plan, the applicant shall install fences which are 7' high and made of 4x4 wire. The O'Brien Group states that 4x4 wire is not a standard manufactured item, and they propose 2x4 wire openings. They also believe that 2x4 wire openings are sturdier and more difficult to climb than the 4x4 openings. Staff checked with Santa Clara County Parks Department to determine if they had any concerns about this modification, and they do not. Staff has no problem with the proposed change. Action The Director of Community Development approves the modification to condition 18 to allow a 2x4 opening fence.
