Subject: Director's Decision Regarding Minor Modification (2-U-98)
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval
of minor changes to a project. The Director reports his decision to the City Council
and Planning Commission in time to allow any Council member or Planning
Commissioner to appeal the decision within fourteen calendar days.
Application:
The applicant is seeking permission to erect a canopy in the play yard of a daycare center
located at 10352 North Stelling Road.
Discussion:
The canopy would be used to provide shade for the children enrolled at the daycare center
during the warm summer months. The canopy measures 11 feet at the peak height and is
constructed of steel tubing and polyethylene fabric.
Staffs main concern with the canopy height is the visibility from neighboring homes. The
applicant was directed to meet with neighboring property owners and notify them of his intent to
install the canopy. Two homes to the rear of the subject property are currently under
construction, while the same owner of the daycare property owns a property to the north. The
daycare operator has secured a letter from the property to the south stating that they are not
concerned with the proposed canopy. The two properties to the rear have been notified in
writing by the daycare operator (see attached correspondence). To date, the property owners to
the rear have contacted neither the city nor the daycare operator. To help clarify which property
owners have been notified and which have stated they do not object to the installation of the
canopy, staff has provided the attached annotated assessor parcel map.
Action:
The Director of Community Development approves the minor modification.
