Chapter 19.128 of the Cupertino Municipal Code allows the Director of
Community Development to grant a conditional use permit authorizing the use
of a site in any zoning district for a temporary use.
Applicant:
Matthews Land Company, 5619 Scotts Valley Drive, Suite 200, Scotts Valley, CA
95066, for Sprint PCS
Application:
Director's Minor Modification, file no. 11-U-73(M) to allow three, roof-mounted, PCS
panel antennae and related radio equipment on Building #47 of the Hewlett Packard
Campus at 19111 Pruneridge Avenue.
Subject:
This is a Director's Minor Modification to approve a Personal Communication Services
(PCS) aerial facility on the .rooftop of a two-story office building located at the Hewlett
Packard campus at the comer of Wolfe Road and Pruneridge A venue. The primary
purpose of the aerial is to provide adequate in-building coverage for the campus and
secondarily, radio coverage for surrounding streets (Exhibit A). The panel antennae are
sited on three comers of the building and are at the maximum height (6 feet maximum
above roof parapet) allowed by ordinance given its setback from the parapet. The base
radio equipment sits in an equipment well on the building roof and will not be visible.
The antennae will have negligible visibility because of its setback of at least 600 feet
from a public right-of-way.
Staff questioned the applicant to determine if radio coverage was adequate in Vallco
Industrial Park as staff believes this particular site can accommodate a taller or larger
aerial with wider coverage versus locating a second aerial facility somewhere else in the
the industrial park. The applicant indicated that Sprint PCS felt radio coverage was
adequate in the area, with the exception of the Hewlett Packard vicinity, and there were
no future plans to add additional aerial facilities in the area.
Staff finds that the aerial augments an existing technology which complies with Federal
Communications Commission safety standards.
Action Taken:
The approval is based upon the attached plan set titled: "Sprint PCS BLACK
SF33xc511A, 19111 Pruneridge Avenue, Cupertino, CA 95014, County of Santa Clara"
and consisting of four pages labeled T-I, A-I, A-2 and A-3, and further subject to the
following conditions of approval:
1) If the aerial is not used for its permitted purpose for a period of 18 months, the aerial
and its associated facilities shall be removed. The cost of demolition shall be borne
by the property owner or applicant.
2) There is a 5-year expiration date on this permit. Before the expiration date, the
applicant may apply for a time extension at which point the state of its technology
will be reviewed in conjunction with the project. The expiration date shall be August
31,2005 or a later date approved by the Planning Commission upon the appeal of the
project.
This Director's decision is subject to a 14 calendar day appeal. The appeal process ends
on September 14,2000.
