Chapter 19.132 ofthe Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application:
Minor Modification to allow the attachment of two, 2 %" x 3' PCS panel antennae and a
microcell equipment cabinet on an existing utility pole in the public right-of-way
(Foothill Blvd.) next to Monta Vista Park.
Description:
The applicant, Pacific Bell Wireless, is requesting the attachment of a "microcell" aerial
installation on an exsting high voltage power pole on the Foothill Boulevard right-of-
way, abutting Monta Vista Park and across the street from Walnut Circle North.
A microcell is a low power aerial facility designed to serve a small area, usually filling a
radio coverage hole for a Personal Communications Services (PCS) carrier. This one is
oriented to provide coverage along Foothill Boulevard. As been previously reported to
the Planning Commission by a number of wireless carriers, the west side of Cupertino has
poorer radio coverage than all other areas of the City (see attached antenna inventory list
and map).
The City's wireless communications facilities ordinance requires such aerials to be
setback from residential properties 50 feet or the height of the antenna, whichever is
greater. In this case, the setback is 61 feet and the antenna is mounted only about 35 feet
above grade, so the project conforms with this section of the ordinance.
Given the distance to residences, the applicant has supplied a report documenting the
radio emission levels for a micro cell antenna in relation to Federal exposure standards
(Exhibit B).
This line of power poles is not part of any current City undergrounding utility district nor
are there plans to form one. The Foothill Boulevard power poles are part of the primary
electrical power distribution network, which are not normally undergrounded by Pacific
Gas and Electric.
The panel antennae and microcell cabinet will be painted to match the pole.
Action:
The Director finds the microcell aerial facility to be small and unobtrusive, and blends in
well with the other equipment attached to the pole (See photo simulation). The Director
of Community Development deems the modification minor and conditionally approves
the modification as depicted in exhibits titled "Pacific Bell Wireless SF 638-02 Stevens
Creek Cupertino, CA", consisting of four sheets labeled T 1, C-l, Al & A2 dated 4/17/00
and 5/2/00.
The first condition of approval provides for the removal of the aerial and its associated
facilities if the aerial is not used for its permitted purpose for a period of eighteen (18)
months.
The second condition of approval provides for a 5-year expiration date on this permit.
Before the expiration date, the applicant may apply for a time extension at which point
the state of its technology will be reviewed in conjunction with the project. The
expiration date shall be August 3, 2005 or a later date approved by the Planning
Commission upon the appeal of the project.

This approval of the modification is effective August 7, 2000. The fourteen calendar day
appeal period will expire on August 21,2000.
