Subj: Report of Director's Decision regarding a Minor Modification.

Chapter 19.128 of the Cupertino Municipal Code allows for administrative issuance of minor
modifications of a use permit. The Director reports his decision to the City Council and Planning
Commission in time to allow any Councilmember or Planning Commissioner to appeal the
decision within fourteen calendar days.
Application:

Action:
The Director of Community Development deems the changes minor and approves the minor
modifications for the building in accordance with the revised exhibits titled "Remodel #2 Jan
DeCarli Residence" 11640 Regnart Canyon Road, Cupertino, California," last revised on 6/05/00
and consisting of five sheets labeled 1, 4, 5, 6 and L.1.
This approval of the modification is effective June 20,2000. The fourteen-calendar day appeal
period will expire on July 5, 2000.
Background: .
The Planning Commission on April 9, 1996 approved the hillside exception for phase one of the
improvements planned for the subject property. The exception enabled the expansion of an
existing residential structure on a prominent ridge line for a new great room and garage storage
area totaling 2081 square feet on the west portion of the structure. Construction is nearing
completion. (Exhibit A, Construction Phases)
Description:
The applicant has submitted plans, modifying and adding to the exterior of the structure on the
middle and east portions (Exhibit A). The modifications include:
. Removing the rear triangular shaped popout window and creating a bay style window.

. Raising the Porte cochere.
· Expanding the deck on the rear or north side of the existing structure.
· Adding a nine-foot tall, 480 square-foot trellis on the east side of the structure.
Discussion:
Rear Window Popout
This 47.5 square-foot modification will not extend beyond the north most point of the existing
exterior of the structure (Exhibit B, North-side Window Popout).
Porte Corchere
The applicant has proposed the change to increase the vertical clearance under the eaves from
seven feet to eight feet two inches, creating a more attractive and useful entry area (Exhibit C,
South-side Porte Cochere). By increasing the vertical clearance under the eaves, the roof ridge
height will be correspondingly increased. To reduce the overall height increase, the existing roof
pitch will be altered from 7: 12 to 5: 12, thereby raising the peak roof ridge by only 6 inches rather
than 1 foot, 2 inches if the roof pitch is not reduced (Exhibit D, Porte Cochere Cross Section,
Photo 1, Porte Cochere Ridge Line).
Deck Expansion
This exhibit shows the approximate location and size of the existing deck. The existing wood
deck will be demolished and reduced in size by lowering approximately 883 square feet of the
center deck section to the existing grade (Exhibit E - Existing and new wood decks). The other
two sections of the deck will be slightly increased in size and placed on new piers at the same
height as the existing deck. The deck surface will be tile.
Trellis
An olive tree currently exists in this location. The applicant will build the trellis around the tree
(Exhibit F - Eastside Trellis, photo 2 - East-side structure). The trellis will be minimally visible
from the adjacent properties (photo 3 & 4 - Downslope east and north).
Visibility
Staff took pictures from the west, since this was the area from which most of the modifications
will be visible. The project is barely visible from the valley floor and not visible at all from the
south and west neighboring properties. From all the photo perspectives presented in this report,
staff considers the changes to be de minimus (Photos 5 and 6, West perspective Photos).
