Subject: Director's Minor Modification
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in
a project. The Director reports his decision to the City Council and Planning Commission in time to
allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar
days.
Application
Minor modification of 36-U-86(m) to allow 68 square feet of amenity space and reduce the second floor by 208
square feet.
Description
The applicant proposes to reduce the floor area to an existing office building by 103 square feet and to add
78 square feet by enclosing a recessed secondary access area on the first floor (Exhibit A) and reducing
the existing second floor by 181 square feet (Exhibit B). The applicant has proposed the enclosure for
aesthetic reasons. The new enclosed area will be clear from the first floor to the second floor ceiling
(Exhibit C, Elevation and Cross Section). Since the new enclosure reduces the total floor area of the
building, the addition does not require any office square footage allocation. The addition will match the
existing materials and color of the building's present exterior and is in compliance with Municipal Code
for setbacks and parking (Exhibit C, East Elevation). The main entrance is located to the rear, away from
the public street (Exhibit D, Building Access Points). Therefore, the addition to the fayade is considered
de minimus and staff supports the modification.
Action
The Director of Community Development approves the modification shown in the exhibits titled "Title
Sheet," "East Elevation," and "Entry Section," consisting of Sheet A and AO.O, dated April 19, 2000.
This approval of the modification is effective June 7, 2000. The fourteen calendar day appeal period will
expire on June 21,2000.
