Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.

Sprint PCS/Whalen & Company, Inc., 3875 Hopyard Road #245, Pleasanton, CA 94588
Application:
Minor Modification of 08-U-87 to allow two panel PCS antennae on a Pacific, Gas and
Electric Co. (PG&E) lattice tower, a fenced pad to store PCS equipment cabinets and a
parking stall on a private road which is an extension of California Oak Way.
This PCS aerial site is proposed to be located on a lattice tower situated near the middle
of PG&E substation lands accessible from California Oak Way (See Exhibit A - Vicinity
Map). This proposed Sprint PCS aerial site is an alternative location to provide PCS
coverage for the western side of Cupertino. Sprint PCS originally obtained Commission
approval for a monopole in an office/retail center located on the northwest comer of
Stevens Creek Blvd. and Foothill Blvd. (10011 North Foothill Blvd.), but later failed to
secure a land lease agreement with the office condominium property owners association.
The use permit application was signed by one of the condominium owners and
representative of the association, but he neglected to obtain association approval before
pursuing this arrangement with Sprint PCS.
On several occasions, staff and the Commission articulated their preference for a PCS
aerial site on PG&E substation lands, rather than a Foothill Blvd. location. The
applicant argued that the substation site was not workable from a radio engineering
standpoint. The applicant has changed its mind (Exhibit B) and is accepting what it
perceives as a less than optimum site because there are no other choices.
Viewing the photo simulation and Sheet Al of the plan set, the panel antennae will be
hung low on the lattice tower and the cabinet pad will be screened by existing trees and
shrubs. What is not shown in the photo simulation is the proposed walkway, parking
space and concrete retaining wall which will be visible from the private PG& E road.
None of the structures will be visible from public rights-of-way because of the distance
(over 400 feet) from the street. Public Works Dept. has no storm drainage concerns
because of the miniscule amount of impervious surface in relation to the entire site.
Findings:
1) Staff finds that the subject aerial as proposed will have a minimal visual impact.
2) The aerial augments an existing technology which complies with Federal
Communications Commission safety standards.
Action:
The Director of Community Development deems the modification minor and approves
the antennae addition to the lattice tower and supporting equipment based on the attached
plan set titled "Upper Monte Vista Substation, SF33xC554-D, California Oak Way,
Cupertino, CA 95014" consisting of 5 sheets dated 4/28/00 and labeled T -1, AI, A2, A3
& A4 except as may be modified by the following conditions:
1) that if the aerial is not used for its permitted purpose for a period of 18 months, the
aerial and its associated facilities shall be removed. The cost of demolition shall be
borne by the property owner or applicant.
2) that the panel antennae shall be painted the same flat color as the lattice tower.
3) that the applicant shall ensure the screening of the equipment enclosure from public
view, using native shrubs and trees.
This approval of the modification is effective May 19,2000. The fourteen calendar day
appeal period will expire on June 2, 2000.
