Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow any Counci1member or Planning Commissioner to appeal the decision within fourteen calendar days. Application Minor modification of6-U-97, Gary and Terri Ettinger, Lot 5-22, 10948 Sycamore Drive to allow a solid fence on a lot where an open fence is required. Discussion The use permit for the Oak Valley Subdivision Development required that certain lots have open woven fences instead of solid wood, as shown on sheet L-1. The owner of lot 22 is requesting to have a solid fence rather than the open fence that was approved for this lot. The original reason for requiring open fences along this boundary of Neighborhood 1 was to provide a soft transition between the riparian corridor and the development. However, the applicants have presented evidence that they have a loss of privacy in their rear yard, as viewed by people using the trail that accesses the Mid-peninsula Regional Open Space property. Staff has verified this situation on site and concurs that it would be a hardship for the property owners to be exposed to the large numbers of people who pass this area each day. Action The Director approves a modification of the approved plan to allow a solid wood fence for lot 22.
