Subj: Report of Director's Decision regarding a minor modification.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval ol•
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner
to appeal the decision within fourteen calendar days.
Application
Minor modification of 31-U-71, a Planned Development (De Anza Oaks) consisting ol'21 1 units.
The modification would allow a 231 square foot addition to a 2,254 square Foot residence on a
2,010 square foot lot. The addition, a sun room, already exists, and the property owner seela
approval of it in order to secure building permits for structural improvements.
The sun room was built without building permits by the previous property owner. n dccl: was
also extended beyond the property line to a sound wall The deck crosses a Public Service
Easement (PSE) used for storm drainage purposes.
Discussion
Floor Area Ratio:
The existing floor area ratio (FAR) is 112.2% and proposed is 120.7%. Although this is a high
FAR, staff believes there are no negative visual impacts from the addition. On either side, the
sun room does not create any privacy impacts on the adjacent townhomes, and on the rear, is not
visible from Stevens Creek Boulevard. The sun room does create a wall adjacent to the scar yard
of Lot 188, but this is along-standing situation and the Homeowners' association approved the
addition.
Public Service Easement:
The Public Service Easement, dedicated to the City, exists between the rear property line and
Stevens Creek Boulevard. The PSE is owned and maintained by the Homeowners' association.
A sound wall was built in the PSE, and the previous property owner (and apparently others)
extended their decks beyond the rear property to the wal I.
The City's Public Works Department indicates they would approve the deck over the casement
as long as access is provided for storm drain maintenance by the Homeowners' nssocialion.

Action
The Director approves the modifications with the following condition:
Access shall be provided to the Public Service Easement for storm drain maintenance by
the Homeowners' Association, to the satisfaction of the Building Department.
