The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. Application: Minor Modification of 37-U-71 to allow the removal of five specimen size Eucalyptus trees at the De Anza Oaks Development, near Units #42 & #43 on Firwood Drive. Description: The Oak Meadows Homeowners Association has requested approval to remove five specimen size Eucalyptus trees at the De Anza Oaks Residential Planned Development located off Stevens Creek Boulevard near the west foothills. The five trees are growing in a narrow planting strip alongside units #42 and #43 and Firwood Drive, a private street (See Exhibits A & B). The five trees are forty to sixty feet tall with diameters of24 to 36 inches. The trees are in good health, but have outgrown the relatively narrow planting strip (about 7 feet wide). The applicant's arborist has stated that the trees are high maintenance and have a propensity of throwing off large limbs which is of significant concern because of the proximity of residential dwellings underneath and next to the trees in question (Exhibit C). Staff agrees with the arborist's assessment. Staff notes several incidents in Cupertino where Eucalyptus trees have dropped large branches without warning on residential properties and commercial parking lots. Many of the shopping centers in the City with such large Eucalyptus trees have already received City permission to replace them. In staffs drive through of this 43.1-acre development, of which more than 1/3 of the area has been dedicated to private open space, staff noted the community was very well- landscaped and well-forested with hundreds of trees in the developed portion alone. The locations of the Eucalyptus trees were not visible from the public street. For these reaso~s, staff has not recommended that these trees be replaced with new trees. Action: The Director of Community Development deems the modification minor and approves the removal of the five Eucalyptus trees as depicted on the location map and photographs. This approval of the modification is effective March 1,2001. The fourteen calendar day appeal period will expire on March 15,2001. Many of these trees, when first planted, seemed to fit into their surroundings. They have grown too large for their location. The Board of Directors' have decided that these five (5) large eucalyptus trees, which are very close to units #42 and #43, are too large and represent a potential safety hazard to the community. Several large branches are hanging over these units and could cause major damage if they fell on the roofs or into the street. Approximately six weeks ago, one large branch suddenly and without warning cracked and fell into the street. Fortunately, no people or cars were present at the time. We therefore are requesting permission to remove these trees immediately to insure the safety of our community. Your immediate attention to this urgent request is appreciated.
