Subject: Report of Director's Decision Regarding a Minor Modification to a single-
family home in the PeRes) zone at the Oak Valley Development.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner
to appeal the decision within fourteen calendar days.
Action Taken
The Director approves the modification. This approval of the modification is effective December
18, 2001. The fourteen calendar day appeal period wi]] expire on January 2, 2002.
Backeround
Modification of Application No. 6-U-97 and I 1-ASA-98, 22179 Hammond Way at the Oak
Valley Development to enclose four existing patios (total of 666 square feet).
Discussion
The Oak Valley Development is a planned single~family residential development in the Rancho
San Antonio area approved as part of use permit 6-U-97. The property is zoned P(Res)-Planned
Residential Development zoning with single-family homes permitted. The single-family home
where the project is proposed was approved as part of application number ll-ASA-98. New
single~family homes in this neighborhood are subject to design review. The existing home built
on a 4,63 acre lot, is an updated ranch style home and has an area of 5657 square feet (including
the garage but excluding the patio areas).
The applicant proposes to enclose 666 square feet of two covered and two uncovered patio areas
(A- D). The addition increases the building area from 5657 square feet and an FAR of 2.8% to
6323 square feet with an FAR of 3,13%. The addition is consistent with the use permit, which
allows home sizes to a maximum of 6500 square feet and an FAR of 40%. Two of the patio
enclosures (B & D) propose to enclose covered patios with glazing to match the design of the
existing home. The other two patios (A & C) proposed to be covered with curved glazed roofing
are located to the rear of the house and will not be visible from the street. The framing will
match the color (Dense Forest green) of the existing window trim and the glazing is proposed to
be Solex (light green). Projects in the Oak Valley development are also required to get approval
from the Oak Valley Architectural Review Committee. The proposed project was approved on
October 29, 2001 as being consistent with the Oak Valley Architectural and Landscape
Guidelines (see attached letter). The project does not propose any additional changes to the
existing landscaping or drainage patterns. Staff considers the addition minor and generally
consistent with the approved use permit.
