Subject: Report of Director's Minor Modification 28-DIR-Ol
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes
in a project. The Director reports his decision to the City Council and Planning Commission in time to
allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar
days.
Proiect Description:
Director's minor modification to an existing use permit (09-U-88) for a 149 square foot addition to an existing
single family residence in a planned residential zoning district, peRES 4.4-12) at 21867 Granada Avenue.
Discussion:
The applicant proposes a 149 square foot, single-story addition to an existing 2,497 square foot residence, for a
total of 2,626 square feet. The net lot size is 5,131 square feet, not including the access corridor. The proposed
Floor Area Ratio (FAR) is 51.5%.
The addition is proposed on the first floor at the rear of the lot. It is aligned with the rear wall of the existing
dining room and the side wall of the existing living room. No negative impacts are associated with this
location. The proposed floor area ratio exceeds the standard R-l FAR maximum of 45%, but it is possible to
exceed that ratio in this development because it is not an R -1 or a peR -1) zoning district.
The applicant provided information regarding floor area ratios in the surrounding area, and many of them
exceed the 45% R-l standard, as shown in the enclosed exhibit. The adjacent lot to the east (number 132) has
approximately the same FAR as the applicant's proposed development. The adjacent neighbor provided a letter
of support for the addition, which is enclosed.
As a side issue, there is a small, portable storage shed located near the front right side of the subj ect property
that does not meet the minimum setbacks for accessory structures, so the shed needs to be moved as a condition
of approval.
Action:
The Director of Community Development approves the modification on the condition that the small, portable
storage shed be moved to meet the accessory structure setback requirements.
