Subject: Report of Director's Minor Modification to a use permit modification for a 248
square foot addition to an existing residence at 10492 Peralta Court (Oak Valley)
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner
to appeal the decision within fourteen calendar days.
Project Description:
Director's minor modification to a use permit modification for a 248 square foot addition to an
existing residence at 10492 Peralta Court (Oak Valley)
Recommendation:
Staff recommends approval of:
1. 23-DIR-Ol
Back2round:
The applicants propose a 248 square foot bonus room addition to their 4,086 square foot
residence, for a total of 4,334 square feet. The addition will be at the rear of the lot. The approved
use permit for the Oak Valley development permits modifications to approved plans if they
conform to the specific regulations adopted as part of the permit.

The proposed addition conforms to the regulations. The property to the rear has a higher
building pad than the subject party, and looks down on the rear yard where the addition will be.
The applicant is planting trees at the rear property line, so visibility of the addition will be
reduced.
The Oak Valley Architectural Review Committee approved the addition. Affected neighbors to
the side and rear state that they approve the addition (Exhibit A).

Staff believes the addition has no negative impacts.
Action:
The Director approves the modification according to the enclosed plan set.

Dear Homeowner:
The Oak Valley Architectural Review Committee has approved the submission for landscaping and an
addition for the residence at 10492 Peralta Court prepared by Ellen Cooper & Associates dated 6/27/01.
Please note that, in addition to the Oak Valley Architectural and Landscape Guidelines, all requests and
plans are subject to any and all rules, regulations and permit regulations of the City of Cupertino, and it is
the responsibility of the homeowner to contact the City and secure appropriate approvals.
Any alterations to the drainage pattern initially installed by The O'Brien Group should be done with input
and counsel of a licensed civil engineer. Please refer to Section 4.5 of the Declaration of Covenants,
Conditions and Restrictions of Oak Valley for the specific requirements and homeowner responsibilities
regarding drainage.
In addition, our experience has been over many years that it is always a good idea for homeowners to
review landscaping plans with their neighbors prior to construction. There may be impacts on the neighbors
that homeowners have not anticipated and a prior discussion affords an opportunity to address any concerns
at the outset.
