Report of Director's Decision Regarding a Minor Modification to allow an outdoor patio
area at 10235 S. De Anza Blvd.

Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor
changes in a project. The Director reports his decision to the City Council and Planning
Commission in time to allow any Councilmember or Planning Commissioner to appeal the
decision within fourteen calendar days.
Application
Director's Decision to approve a Minor Modification to 24- U -81 to allow a 500 sq. ft. outdoor patio area
at an existing commercial shopping center located at 10235 S. De Anza Blvd.
Discussion
The applicant, Mr. Michael Mansch, proposes to remove three parking spaces adjacent to Alotta's Deli
and replace it with an outdoor patio area. Staff supports such outdoor activity areas.
Staff s only concerns were neighborhood impacts, parking and storm water runoff.
The applicant provided a signed statement from the neighboring single-family residence. In that letter,
the neighbor states that this project "can do nothing but enhance both his Cafe and the front view from
my property." Due to the small size of the project and the support of the most affected neighbor, staff
does not believe this project warrants a public hearing.
The applicant intends to resurface the parking lot for the shopping center. The parking lot currently has
full size spaces that are 9' to 9'6" wide. The parking lot will be restriped to uni-size stalls that are 8'6"
in width. The restriping will pick up sufficient parking stalls to accommodate the loss due to the new
patio area.
The project supports the goal of reducing storm water runoff. The patio area will be constructed out of
interlocking pavers (or a comparable substitute) on a sand base. This will allow water infiltration on the
patio. Surrounding the patio on three sides are landscaping strips (with the building on the fourth side).
These landscaped strips provide a buffer between the patio area and the adjacent impervious sidewalk
and parking lot. Excess runoff from the patio area will infiltrate into the landscaped strips. Only
significant amounts of rainfall will result in storm water escaping the patio area to the storm drain
system. This is a major improvement over existing conditions.
This approval of the modification is effective August 23,2001. The appeal period will expire on
September 6, 2001.
