Report of Director's Decision Regarding a Minor Modification

Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner
to appeal the decision within fourteen calendar days.

Discussion
The applicant proposes an exterior, fenced patio area at the rear of a Coldwell Bank site at 10105
S. DeAnza Blvd.. The proposal would reduce the size of an existing trash enclosure and provide
approximately 300 sq ft of outdoor patio space for employees. The existing bank has service
doors at the rear that open directly into the trash area. The proposed plan would allow for those
service doors to be used by employees to access the building. A walkway is provided from the
doorway to an unused paved area adjacent to the trash area. A natural redwood fence will line
the paved area and the walkway. The fencing along the trash area will have a maximum
separation of 1/8" between the vertical redwood planks. The fencing along the new patio area
will have spacing of 5-6" between planks, creating the appearance of a defined, open area.
Since the work is at the rear ofthe property, staff considers the visual impact of this project to be
minor. Public Works staff reviewed the proposal and determined that the reduced trash enclosure
will accommodate the necessary trash containers and recycling bins. The walkway meets ADA
requirements for accessibility.
Action
The Director of Community Development approves the minor modification.

Memo To be attached as an addendum to the construction documents
1. The finish at the wood fence shall be natural redwood.
2. In the portion of the fence separating th~ trash enclosure area from the patio area, the vertical
redwood planks shall be placed a maximum of 1/8" apart and shall have a horizontal member half
way between the bottom and top of the fence on the trash enclosure side anchored to each vertical
member.
3. This is to confirm that the existing trash enclosure is of solid, opaque construction.
