WHERE'AS, Section 6.24.090 of the 0Jpertin0 MJnicipal Code states that
it is unlawful for anyone in the City of 0Jpertin0 to throw or deposit
refuse, garbage or waste, or to cause the same to be thrown or deposited,
upon any street, alley, gutter, park, or other public place, or to throw
or deposit the same in or upon any vacant lot, or back yard, or to store
or keep the same otlJetwise than in containers as required by Sections
6.24.060 ~ 6.24.080; and
WHERE'AS, Section 9.08.01OA states that no owner, agent, or lessee or
other person oc:cupyin3 or havin3 charge or control of any buildin1, lot,
or pI'F!llli"eS within the City shall permit weeds to remain upon the premises
or public sidewalks or streets or alleys between the premises and the
center of the line of any public street or alley; and
WHERE'AS, there is located at the southeast co:mer of Hanestead Road
and Foothill Boulevard, the CUpertino section of the parkiIx] lot of the
shoppin3 center on Homestead Road and Foothill Boulevard, an at"Y"'lmn,' ation
of trash and weeds; and
WHERE'AS, the trash and weeds have not been :t'eIWVed for a lorq period
of time and will ~ a fire hazard durin3 the ch:y Sð~= and may be a
health hazard and are an eyesore to adjacent property owners; and
WHERE'AS, as provided by Ordinance No. 794, the City COuncil shall hold
a public heari!); ' to detemine whether or not said contition constitutes a
public nuisance and, if said determination is made, the City COuncil shall
require abatement of said public nuisance by renx:waJ. of trash and weeI)¡¡;
NOO, 'lHEREFORE, BE IT RESOLVED that the City cnmcil of the City of
CUpertino does, upon adoption of this resolution, establish the date of
November 16, 1987, 6:45 p.m., as the time and 10500 North DeAnza
Boulevard, 0Jpertin0, California as the place wherein public testim:my
will be taken relative to the determination as to whether or not a public
nuisance exists and if so determined, what type of abatement is necessëU:y.
