Description:
The applicant, Nextel CQmmunicatioDS, is requesting the approval .of a 12-panel
antennae array on the. roof of the Flint Center and a radio equipment shelter at the base .of
the building. The building is loeated an the De Anza College Campus and is surrounded
by ather college facilities andle east, south and west sides and a campus perimeter road,
Stevens Creek B,oulevardand the Oaks Shopping Center on the north side.
The property is zoned "BA " - Public Building. Because, .of its height and IOcatian, the
Flint Center has been a favarable. site to locate telecommunications facilities. Sucb
facilities tbatserve the communication needs .of the college are not subject to City review;
hawever,the Nextel proposal,. which is a commercial enterprise an school land, is
subject to City review. This distinction between a "school"use and a "commercial" use
was not understood by De ADza ColleJe .or Nextel Communications and the college
approved a rooftop aerial facility and base equipment station sometime in 1998 without
City approval. The facility was built in 1999'. The laek of City approvals was discovered
by staffwhen NextelappUed for an expansion of this existing aerial facility. The City
has not received any complaints .ut this unpermitted aerial facility.

The eximni_ility eonsilts oftbree 4-foot long J*lel aa~ 1jicing so~ and
mounted on a rooftop equipment screen, and three other panel antennae oriented west and
screened by three fiberglass pilasters that mimic. existingarcbitectural pilasters on the
Flint Center. The expandedaerlal site consists of:
a) the addition otone 4-foot panel antenna facing south,
b) the addition of one 4-foot panel antenna facing west ~screened bya
fiberglass pilaster,
c) the addition of four 4-foot panel antennae facing east and screened by
fiberglass pilasters,
d) the addition of a 10' x 20' x 10' equipment shelter located north and west of
the Flint Center in a landscaping island.
The new antennae mimic the existing configuration of Nextel antennae which are well
screened from public views. All of the antennae meet City standards for beightand
setback on the roof. The antennae closest to the builditlg walls will be housed in
fiberglass pilasters that atecotored, shaped and aligned to match the pilasters on the
building waIls. The south-facing panel antennae are set backed a good distancc.from the
building walls and have minimal visibility. The equipment shelter is proposed, in a
location where tbereare several medium-size trees. The trees win be relocated slightly
north oftbe shelter. This transplanted row of trees, along with two other existing rows of
trees will screen the enclosure from Stevens Creek Boulevard pubJicviews.
Adieu:
The Director nnds the proposed aerial facility to be unobtnJsiveand architecturally
integrated with the building (See photosimulations). The Director of Community
Development deems the modification minor and conditionally approves.tbe modification
as depicted in~bits titled" NEXTEL SPECIALIZED MOBILE RADIO FACILITY,
SITE NAME: DE ANZA, SITE NUMBER CA-0826A'" consisUngof eighteen sheets
labeled TI, T-2, C-l, Al through A9, EI through E3, LI and two unlabeled sheets dated
3/21/01. .
The first condition of approval provides for the removal oftbe aerial and its associated
facilities if the aerial is not used for its permitted purpose fora period of ' eighteen months.
The second condition of approval provides fora S-year exphirtion date on this permit.
Before the expiration date, the appli~ may apply fora time. extension at which point
the state of its technology will be reviewed in conjunction with the project. The
expiration date shall be May 16, 2006 or a later date approved by the Planning
Commission upon the appeal of the project.
This approval of the IJ1Odjfication is effective May 16, 200 1. The fourteen calendar day
appeal periodwiU expire on May 30, 2001.
