Modification.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor
changes in a project. The Director reports his decision to the City Council and Planning

Commission in time to allow any Councilmember or Planning Commissioner to appeal the
decision within fourteen calendar days.
Application
Extension of an approved minor modification (31-U-71), 22951 Longdown Road, a Planned
Development (De Anza Oaks) consisting of211 units.
Background
On January 13, 2001, the applicant received approval for a minor modification that allowed a
231 square foot addition to a 2,254 square foot residence on a 2,010 square foot lot. The
addition, a sunroom, already exists, and the property owner sought approval of it in order to
secure building permits for structural improvements.
The sunroom was built without building permits by the previous property owner. A deck was
also extended beyond the property line to a sound wall. The deck crosses a Public Service
Easement (PSE) used for storm drainage purposes.
Description
The applicant is seeking approval for a one-year extension on minor modification #31-U -71.
The Cupertino Building Department is currently in the process of approving the plans for the
structural improvements.
Action
The Director of Community Development will extend Minor Modification #31-U-71 until
January 13,2003.

Dear Mr. Piasecki,
I am writing to request an extension of the Director's approval for a Minor Modification
that I received from your department almost two years ago. This minor modification
would allow an addition at my townhouse, a sunroom that was built by the former
owners, in order to secure building permits for necessary structural improvements. My
townhouse is located at 22951 Longdown Road, in the De Anza Oaks complex off
Stevens Creek Road in Cupertino.
I am currently in the process of having the plans for the structural improvements
approved by the City of Cupertino. However, it is clear to me that the repair work will
not be completed by the January 13,2001 deadline. Though the work will be done as
soon as possible, please allow me an additional year to have all the work completed for
the City's final approval.
Enclosed is the report I received from the city on January 13,2000 regarding the minor
modification.

Discussion
Floor Area Ratio:
The existing floor area ratio (FAR) is 112.2% and proposed is 120.7%. Although this is a high
FAR, staff believes there are no negative visual impacts from the addition. On either side. the
sun room does not create any privacy impacts on the adjacent town homes. and on the rear. is not
visible from Stevens Creek Boulevard. The sun room dots create a wali adjaccnt to the rear yard
of Lot 188, but this is a long-standing situation and the Homeowners' association approwd the
addition.
Public Service Easement:
The Public Service Easement, dedicated to the City, exists between the rear property linc and
Stevens Creek Boulevard. The PSE is owned and maintained by the Homeowners' Assol:iation.
A sound wall was built in the PSE, and the previous property owner (and apparently others)
extended their decks beyond the rear property to the wall.
The City's Public Works Department indicates they would approve the deck ovcr the cascment
as long as access is provided for storm drain maintenance by the Homeowners' Association.

Action
The Director approves the modifications with the following condition:
Access shall be provided to the Public Service Easement for storm drain maintenance hy
the Homeowners' Association, to the satisfaction of the Building Department.
