Subject: Report of Director's Decision Regarding a Minor Modification to a singlc-
family home in the P(Res) zone at the Oak Valley Development.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of '
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner
to appeal the decision within fourteen calendar days.
Action Taken
The Director approves the modification. The approval is effective on January 6,2003. The
fourteen calendar day appeal period will expire on January 20, 2003.
Background
Modification of Application No. 6-U-97, 10958 Sycamore Drive at the Oak Valley IJevelopment
for a 346 square foot addition.
Discussion
The Oak Valley Development is a planned single-family residential development in the Rancho
San Antonio area approved as part of use permit 6-U-97. The property is zoned P(Res)-Planned
Residential Development zoning with single-family homes permitted. The existing 3,323 square
foot home is built 011 a 19,113 square foot lot The applicant proposes to add 346 square feet to
the front of the residence, for a total of 3,669 square feet and a floor area ratio (FAR) of J 9{%.
'The addition is consistent with the use permit, which allmvs a maximum: FAR of 40(/(1. Views of
open space areas from adjacent properties are not affected because the addition is in the thmt.
Projects in the Oak Valley development are also required to get approval from the Oak Valley
Architectural Review Committee. The proposed project was approved on November J 9, 2002
(see attached letter). Adjacent property owners will be notified of the director's approval. Staff
considers the addition minor and consistent with the approved use permit.
Action
The Director approves the modification with the following condition:
The oak tree adjacent to the addition in the garage area shall be protected prior to
demolition and through the construction period.
