Subject Director's Approval of a temporary use permit for "Your Asian Connection",
an internet-based business and social organization focused on promoting and
helping the Asian community.
Chapter 19.128 of the Cupertino Municipal Code allows for administrative
approval of a temporary use permit. The Director reports his decision to
the City Council and Planning Commission in time to allow an appeal of
the decision within fourteen calendar days.
ACTION:
The Director approves the temporary use permit with the following conditions:
1. "Your Asian Connection" shall not be the primary use in the building.
2. Activities, ages and numbers of people shall be limited to those described in this
application. Younger ages are allowed if the building is determined by the building
department to meet building code for younger ages. Higher occupancy on the
weekends, (a maximum of twice a month) is allowed, not to exceed 100 people,
contingent on evidence of recorded documents for shared parking and meeting
building code requirements. Health related activities, such as acupuncture and
chiropractic services, are allowed upon approval of the County Health Department.
The applicant shall provide the Director of Community Development with the
above information prior to exceeding the base limitations.
BACKGROUND:
"Your Asian Connection", as described above, proposes to occupy 4,550 square feet of a
14,049 square foot light industrial building. The floor plan is enclosed, and the space to
be occupied is at the rear of the building. The applicant is applying for a temporary use
permit, and will apply for approval as a permanent use prior to expiration of the
temporary permit.
Chapter 19.128 of the Cupertino Municipal Code (Temporary Uses) allows the Director
of Community Development to grant a temporary use permit without a requirement of
a public hearing or notice. The permit may include authorization to vary from the
specific requirements and regulations of the title as may be solely related to the
requested temporary use.
DISCUSSION:
A description of activities for "Your Asian Connection" is enclosed. Activities are
described as providing Chinese and English classes with a focus on business based
communicationf social interaction and public speaking.
Staff identified three issues related to this proposal:
Use: The Bubb Road area is regulated by the "West Valley Industrial Park" ordinance.
The ordinance includes a list of permitted uses (endosed). Staff believes the proposed
use is similar to the permitted usesf such as professional or administrative offices and
technical college. The proposed use is also not the primary use of the building, which is
a requirement as stated in the condition of approval. Since the proposed use is not
strictly on the list of permitted uses, it is limited to being a secondary use of the
building. When permanent approval for the use is reviewed by the Planning
Commissionf additional analysis will be provided on the appropriateness of this use.
Parking: There are 44 parking spaces on site. The 4,550 square foot applicant's space
requires 16 spaces. Thereforef the proposed uses must not create a demand of more
than 20 spaces during business hours or 44 spaces after business hours. The enclosed
description of activities shows that no more than 20 people will occupy the building
during business hours and 44 after business hours. Staff believes parking is adequate
for these numbers. The applicant may pursue use of adjacent parking during non-
business hours. A condition of approval allows for thisf contingent on evidence of
recorded documents, meeting building codes and not exceeding occupancy of more
than 100 persons.
Building occupancy: Building requirements are affected by the number, ages and
activities of people expected to occupy this space. A condition of approval requires that
classes consist of persons ages 16 and above, unless the building is determined by the
building department to meet building code for younger ages.

helping the Asian community. Your Asian Connection, Inc. regularly holds cultural
seminars, classes and events to promote social/cultural integration and understanding.
Your Asian Connection, Inc. currently maintains a membership of over 1000 single and
married professionals. Our focus is to provide Chinese and English classes to both
Adults and Teenagers with a focus on business based communication, social interaction
and public speaking. Our services also extend themselves to acting as a center for health
information, referral's, minor treatment and an insurance agency with Acupuncture,
Chiropractic and BlueCross/BlueShield services available on site to our members. In
addition our singles and family social services include~ online dating, social dance
lessons and mixers for networking and relaxation, ski trip's, hiking, camping, rafting,
tennis and group/tour travel services.
