The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. Application: Temporary Use Permit, Minor Modification of 08-U~00, (File No. DIR- 2002-38) to extend the duration of the outdoor farmers' market from November 8, 2002 to May 1,2003 at 10123 North Wolfe Road (northwest Valleo Fashion Mall parking lot). Description: The Vallco Certified Farmers' Market (VCFM) was originally approved for Friday hours for a season that extends from May to October. It has exceeded all of the applicant's expectations and due to its success, VCFM, its parent, Pacific Coast Farmers' Market Association (PCFMA) and Valleo Fashion Park have requested temporary extensions of its marketing season for the last two years, except for the late November through December holiday season. Because of this open market's popularity, PCFMA and Valleo Fashion Park have requested to continue the market through the holidays this year, and have applied for a permanent use permit modification to operate year round. Since the public hearing cannot be scheduled until late November and PCFMA's approved season expired in October, the Community Development Director is inclined to temporarily extend the market's season until a permanent use permit can be acted on.. Since its opening in May 2000, the market has been operating without problems or complaints. Action: The Director of Community Development deems the modification minor and approves a 6-month extension ofthe marketing season from November 8, 2002 to May 1,2003. Live music is not approved with this permit. This approval is effective immediately_ The lA-day calendar day appeal period will expire on November 19,2002. Mike Rohde and I have discussed the location and would like to keep the market in its present location. I am aware of a possible move to a "more suitable" location in the near future that may be better for the connnunity. Both Mike and 1 have received numerous requests to continue the market through the holidays this year. We would like to continue operating through December 2002 and the beginning of the New Year. I do realize this is short notice and hope the simplicity of our application is acceptable. Thank you for your time and assistance in bringing the farmers to Cupertino.
