Subject: Director's Minor Modification of application 6-U-97 to add a 395 square foot
bonus room and a minor bedroom addition to an existing 3,578 square foot
residence located at 23615 Oak Valley Road.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Corrunission in time to allow an appeal
of the decision within fourteen calendar days.
ACTION:
The Director approves the modification, with the following condition:
Protection devices shall be installed on the pine and cedar trees adjacent to the
addition prior to any grading or construction.
BACKGROUND:
Modification of application Number 6-U-97 to add a 395 square foot bonus room and a
minor bedroom addition to an existing 3,578 square foot residence
DISCUSSION:
The existing residence was approved as part of the original Oak Valley use permit.
Modifications to approved plans require discretionary review.
The proposed single-story addition is located at the rear of the property, 12 feet from
the side property line and 62 feet from the rear property line. A single-family residence
is located next to the proposed addition and the Forum Retirement Center is located to
the rear.
The proposal conforms to the size and setbacks regulations of the Oak Valley
development, and staff determined that there are no negative impacts related to the
proposal. The adjacent property owners on either side will be notified of this decision.
