SUBJECT: DESIGN REVIEW COMMITTEE ACTION LETTER - Application DIR-2002-15
This letter confirms the decision of the Design Review Committee, given at the meeting
of May 15, 2002, approving a referral of a Director's Minor Modification to modify EXC-
2002-01 related to restaurant signs, according to Design Review Resolution No. 79.
Please be aware that if this permit is not used within one year, it shall expire on
May 15, 2003.
Also note that an appeal of this decision can be made within 14 calendar days of the
decision. If this occurs, you will be notified of a public hearing which will be scheduled
before the Planning Commission.

OF THE DESIGN REVIEW COMMITTEE OF THE CITY OF CUPERTINO FOR
MODIFICATION OF A SIGN EXCEPTION TO CONSTRUCT A RESTAURANT
MONUMENT AND WALL SIGN FOR A PROPOSED HOTEL IN ACCORDANCE WITH
TITLE 17 OF THE CUPERTINO MUNICIPAL CODE.

SECTION II: FINDINGS
WHEREAS, the Design Review Committee of the City of Cupertino received an application
for a Sign Exception modification, as described in this Resolution; and
WHEREAS, the Design Review Committee finds that the changes are beneficial and
compatible with the surrounding area;
1. That the literal enforcement of the proVISIons of this title will result in restrictions
inconsistent with the spirit and intent of this title;
2. That the granting of the exception will not result in a condition which is materially
detrimental to the public health, safety, or welfare; and
3. That the exception to be granted is one that will require the least modification of the
prescribed regulations and the minimum variance that will accomplish the purpose.
NOW, THEREFORE, BE IT RESOLVED:
That after careful consideration of maps, facts, exhibits, testimony and other evidence
submitted in this matter, the application no. DIR-2002-15, is here by approved; and
That the subconclusions upon which the findings and conditions specified in this Resolution
are based and contained in the public hearing record concerning Application DIR-2002-15 as
set forth in the Minutes of the Design Review Committee Meeting of May 15, 2002, and are
incorporated by reference herein.

CONDITIONS ADMINISTERED BY THE COMMUNITY DEVELOPMENT
1. APPROVED EXHIBITS
Approval is based on a plan set entitled: Cypress Hotel, De Anza & Stevens Creek Blvd.
and consisting of two sheets that are unnumbered and dated 6/14/01 (original drawing),
excepted as may be amended by conditions contained in this resolution.
2. SIGN COLORS
Signs colors are as shown in Exhibit A.
3. MONUMENT SIGN LOCATIONS
The monument sign shall be located on the hotel property, and set back at least one foot
from the property line.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other
exactions. You are hereby further notified that the 90-day approval period in which you
may protest these fees, dedications, reservations, and other exactions, pursuant to
Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-
day period complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.

Subject: Director's Minor Modification DIR-2002-15 to change approved canvas
awnings to metal awnings for the Kimpton Hotel located at 10050 S. De Anza
Boulevard. (Modifies 5-U-00)
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
The modification is proposed for a previous approval to the Kimpton (Cypress) Hotel,
cm'rently under construction.
The approved plans for the Kimpton Hotel include red canvas awnings over some of
the windows (see enclosed color rendering). The Kimpton Group requests a change to
metal awnings because the canvas awnings are difficult to maintain (see enclosed
letter). The metal awnings are more expensive than the canvas, according to the
applicant, but are preferred because of the maintenance and appearance problems. The
applicant provided photos of the St. Francis Hotel's metal awnings, which give the
same appearance as canvas. Staff supports the proposed change.
ACTION:
The Director approves the change from canvas to metal awnings.

AS I MENTIONED ON THE PHONE EARLIER TODAY, WE HAVE COME TO THE
REALIZATION THAT THE AWNINGS SCHEDULED TO GO ON OUR HOTEL
PROJECT SHOULD ACTUALLY BE MADE OUT OF METAL AND NOT FABRIC.
THE FIRST FABRICATOR WE CONTACTED INFORMED US THAT FABRIC
A WNINGS HAVE A REDUCED LIFE AND WOULD BE VERY DIFFICULT TO
MAINTAIN IN THE LOCATIONS WHERE THEY ARE BEING INSTALLED. HE
RECOMMENDED TO US THAT WE TAKE A LOOK AT THE METAL CANOPIES
AND AWNINGS HE HAD PROVIDED TO THE ST. FRANCIS HOTEL IN SAN
FRANCISCO. (PLEASE SEE PHOTOS ENCLOSED) AS I HAVE LOOKED
AROUND TOWN AT OTHER FABRIC AWNINGS I HAVE NOTICED THAT
FABRIC FADES, IS EASILY SOILED AND IN EXTREME CASES IS TORN.
WHILE OUR PERMITTED PACKAGE CALLED FOR F ABRIe TO BE USED
AND METAL WOULD BE AN UPCHARGE TO US, WE SUBMIT TRA T THE
METAL CHOICE IS THE BEST MATERIAL FOR THIS APPLICATION. WE
REQUEST THAT YOU REVIEW THIS SUBMISSION AND RESPOND BACK
WITH DIRECTION THAT WOULD ALLOW US TO MAKE THIS MODIFICATION-:.>\~

Dear Mr. Sussman:
Regarding the awnings,. we strongly recommend the use all-aluminum construction,
including panel, instead of fabric. Here is our reasoning:
Fabrie typically requires cleaning twice each vear to maintain its integrity, a difficult and
costly task, given the elevation level at the ninth floor of most ofthe awnings. Because of
the vertical orientation ofthe panels, and the automotive acrylic painted finish on the
aluminum, the panels would require cleaning every other vear.
Fabric generally lasts 8- 10 years, and then needs replacement. The aluminum panels will
last indefinitely
Since most of the awnings are at the ninth floor level, with the balance between the third
and eighth floors, it will be difficult. maybe impossible to detect the difference between
aluminum and fabric.
In summary, there is no question that aluminum awnings is the superior choice for this
project.
