Subject: Director's Minor Modification DIR-2002-12 to convert 182 square feet of attic space to a den
and to add "sun-room" windows and screens to an existing porch. (Modifies 2-U-84)
,Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Conunission in time to allow an appeal of the decision within fourteen calendar
days.
DISCUSSION:
This residential unit is part of a mixed-use office/residential development. There are four residential
units over 4,000 square foot of office space. The original use permit limited each unit to two bedrooms,
due to the number of parking spaces provided.
The applicant proposes to convert 182 square feet of office space to a den (the applicant's unit A4, is
noted on the enclosed aerial). Staff determined that as long as there is no closet space, the proposed den
is not a bedroom. In addition, conditions of approval require that future changes cannot include new
plumbing facilities in the loft or attic area, and a deed restriction shall be recorded stating that the den
will not be utilized as a bedroom.
The applicant proposes to add windows to a rear deck, and staff has no problem with this change,
except that the windows have a similar pane pattern as the other windows on the south elevation.
Another proposed change is to add windows to the proposed den. There are large h'ees at the property
line between the applicant's unit and the resident to the south, and the windows look onto the front
yard and roof of that neighbor. Therefore, privacy concerns are minimal.
ACTION:
The Director approves the application with the following conditions:
A deed restriction shall be recorded that states that the den shall not be used as a bedroom, shall not
have built-in closets, and that no plumbing facilities shall be added to the den, loft or attic area. The
deed restriction form shall be approved by staff and shall be recorded 30 days after approvaL
The Tear deck windows shall have a similar pane pattern as the other windows on the south elevation.
