Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application: File No. DIR-2002-l0: Director's Minor Modification of 10-U-01 to
increase the separation between an existing church and approved conference building
from 16 feet to 20.5 feet at 10110 North De Anza Boulevard.
The applicant, Mr. E. Jack Christensen, Architect for the Roman Catholic Bishop of San
Jose, applied for and received planning commission approval in October 200 I for a
conference room building to be located at St. Joseph's Church. The conference building
was proposed 16 feet away from the church, which necessitates one-hour rated, lire
resistant, double-pane windows in the new building according to City building codes,
The architect later determined that he could not obtain such windows, and has requested
to increase the building separation to 20' 6", which would eliminate the building codc
requirement for such windows (Exhibit A).
The increased separation will not affect other improvements or vehicle circulation. The
alignment of the building entry with the east-west walkway will improve. The increased
separation will be used for wider landscape beds between the buildings.
Action:
The Director of Community Development deems the modification minor and
approves the change per the attached site plan titled: "Plot Plan Modilication-
Conference Building for St. Joseph of Cupertino Parrish, 10110 N. De Anza Blvd.,
Cupertino, CA 95014", consisting of one sheet labeled UP- IX dated 2/27/02.
This approval of the modification is effective March 28,2002. The fourteen calendar
day appeal period will expire on April II, 2002.

To Whom It May Concern:
The approved "Use Permit" of October 8,2001 indicated a separation between the
existing Chapel and the new Conference Building to be 16 feet. In the interim it has
become evident that required one-hour fire resistant, double pane glass windows in the
new building are impossible to obtain.
Therefore, we are requesting that the Conference Building be moved south 4'-6" which
changes the separatkln for windows to 20' -6". This has been verified with George
Barnes of the Santa Clara County Fire Department.
