To: Date: April 1, 2002 Application No.: DIR-2002-06 Subject: Report of Director's Decision Regarding a Minor Modification to a townhouse in the Foothill Corners complex at 10610 S. Foothill Boulevard. Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. Action Taken The Director approves the modification. This approval of the modification is effective April 1, 2002. The fourteen calendar day appeal period will expire on April 15, 2002. Background Modification of Application No. 11-U-79 at 10610 S. Foothill Boulevard to enclose two existing patios (total of 170 square feet). Discussion The project site is in the Foothill Corners townhouse complex approved as part of use permit 11-U-79. The property is zoned P(R1) or Planned Single-Family Residential zoning, and modifications to the development are subject to design review. The existing residence is built on a 2898 square foot lot and has an area of 2104 square feet (including the garage but excluding patios). The applicant proposes to enclose two existing covered patios totaling 170 square feet on the first and second floors. The addition increases the building area from 2104 square feet (FAR 70.77%) to 2274 square feet (FAR 76.64%). The FAR for the townhouses in the development are currently about 70,77%. However, the single-family plmmed development across the su'eet (Kinst Court) has FARs ranging from 75% to 113%. The proposed addition will not be visible from Foothill Boulevard and will not encroach into any existing yard areas. The proposed exterior materials, windows, and doors will be compatible with the existing townhouses. The project was approved by the Foothill Corners Homeowners Association on February 13, 2002, with conditions (which will be included in the conditions of approval for the project). Staff considers the addition minor, and generally consistent with the Foothill Corners townhouse complex and similarly zoned properties in the vicinity.
