Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION: Sprint PCS proposes to install a six panel antenna tree pole and equipment cabinets in the rear parking lot of an existing office site located at 10121 Miller Avenue. The location of the tree pole will not be visible from Stevens Creek Boulevard and Miller Avenue because of it is located behind the existing office complex and partially screened by large trees along the perimeters of the project site. In addition, the tree pole is designed to mimic a real redwood tree with a textured trunk and realistic limbs/ needles. The six antenna panels will be 5' -6" tall mounted at the peak of the tree pole (55 feet maximum from the natural grade). Artificial tree limbs and needles will help to screen the proposed panels from any public view. Both the panels and the antenna mounts will be painted to match the color of the tree pole. The proposed equipment cabinets will be placed at the rear of an existing masonry trash enclosure located at the southwest corner of the parking lot. The equipments will be out of sight and sufficiently screened by existing trees and vegetation. The applicant will be required as a condition of approval to design the tree pole to allow for the collocation of additional future antennas from other wireless service providers. The applicant is agreeable to this condition. ACTION: The Director approves the application, file no. DIR-2002-o4, with the following conditions: 1) The Director's approval expires five (5) years after the effective date of this permit, February 24, 2008. The applicant may renew this permit upon a review of the technology to determine if the visual impact can be further minimized. 2) Aerial facilities not used for its permitted purpose for a period of 18 months is considered abandoned and must be removed by the property owner or applicant who bears the entire cost of demolition. 3) The tree pole shall be designed to mimic a real redwood tree with textured trunk and realistic limbs/needles as shown on the Preserved Treescapes International brochure submitted to the Planning Department on February 2, 2003. 4) The approval is based on plan set titled: JJ SF 922-02, Commerce One (Richwood) 10121 Miller Ave., Cupertino, CA 95014", dated 02/03/03 and consisting of 6 pages labeled Tl, Ct and Al through A4. 5) The applicant shall engineer, design and erect the mast to allow collocation of additional future antennas from other wireless service providers. The applicant shall allow on its mast and any extension, the collocation of other antennas and related facilities where technically feasible and where visual intrusiveness is reduced in comparison to other siting alternatives. The collocation agreement shall be at market rates with reasonable compensation to the mast owner. Any future collocating antennas shall be submitted to a separate permit approval.
