Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. APPLICATION SUMMARY Modification to Civic Park use permit, U-2002-06, to allow removal of four redwood trees that were previously to be relocated in Phase 1. The four redwoods to be removed are proposed to be replaced with four 48" box redwoods along the Building G frontage on Rodrigues Avenue. DISCUSSION As part of the original use permit U-2002-06, redwood trees #56, 57, 58,63, 72 and 73 were to be relocated in the planting strip along the Building G frontage on Rodrigues A venue. The arborist's report prepared subsequent to the use permit approval indicates that the trees cannot be successfully relocated due to their size and root systems. Staff worked with the applicant to minimize the removals to four trees (#56, 57, 63 and 73) and to retain trees #72 and 58. In order to accommodate the trees to be retained, the stair from the garage and the pathway to Rodrigues A venue will be relocated on the east side of Building G so as not to impact the existing trees #58 and 59. The roots of tree #73 and tree #56 and 57 will be cut in place and supervised by the landscape architect to minimize disruption to trees #72 and 58. Structural alternatives including a pier and grade beam at the northwest corner of the building will be explored to minimize digging and damage to the roots of trees #58a nd 59. Also, the sidewalk adjacent to tree #72 will be modified to add a landscape welL Staff believes that these precautions will protect trees #72 and 58. TR-2003-02 Page 2 of2 In the event that trees #72 and 58 do not survive, the applicant shall provide one 48" box redwood tree in the landscape strip adjacent to Rodrigues Avenue as a replacement for each tree. Replacement The four trees approved for removal shall be replaced with four 48" box redwood trees in the planting strip along Rodrigues Avenue where the relocated trees were to be placed. ACTION The Director approves the application with the following conditions: 1. The tree removal is approved only for redwood trees #56, 57} 63 and 73. 2. Trees #73 and 58 shall be retained in their original location with the following conditions: i. The sidewalk shall be modified to provide a landscape well for tree #73. ii. The stair from the underground garage to the north of the building shall be relocated on the east side of Building G to minimize damage to trees #58 and 59. iii-Structural alternatives including a pier and grade beam at the corner of the building shall be pursued to minimize root damage to trees #58 and 59. iv. The roots of tree#73 and 63 shall be cut in place and the procedure supervised by the applicant's landscape architect and/ or arborist to minimize disruption to the adjacent tree #72 to be retained. v. The roots of tree#56 and 57 shall be cut in place and the procedure supervised by the applicant's landscape architect and/ or arborist to minimize disruption to the adjacent tree #58 to be retained. 3. In the event that trees #72 and 58 do not survive} the applicant shall provide one 48" box redwood tree in the landscape strip adjacent to Rodrigues Avenue as a replacement for each tree.
