Subject: Director's temporary use-permit to permit a temporary haunted house in
the Vallco Fashion MalL
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning
Commissioner to appeal the decision within fourteen calendar days.
Action Taken
The Director approves the temporary use permit, with the following condition:
1. The applicant/ owner must secure all necessary permits and approvals from Fire and
Building Departments prior to conunencement of the event.
2. This temporary use permit is shall expire on November 1,2003.
This approval is effective September 15, 2003. The fourteen-calendar day appeal period will
expire on September 29, 2003.
Discussion
The applicant (Worldwide Attractions) is proposing to operate a temporary haunted house
attraction (Gyro 3D Fear Factory) located in the ex Tilt space in the lower floor of Valko
Fashion Park. The haunted house will open from October 9th to 12th, 16th to 19th, 23rd and
November 1st of 2003. The hours of the attraction will be from 7 P.M. to Midnight (Fridays &
Saturdays), 7 P.M. to 10 P.M. (Thursdays & Sundays).
The applicant is also proposing a small museum shop and a retail shop in the mall that opens
during normal mall business hours. The project has been preliminary reviewed by Fire,
Building and Police Departments. The Police Department has no additional concerns however
the project will be required to receive final Fire and Building Department clearances prior to
commencement of the use.
