The Director reports his decision to the City Council and Planning Commission in time to allow any Councilmember or Planning Commissioner to appeal the decision within fourteen calendar days. Application: File No. DIR-2003-09: Minor Modification of 33-U-87 to allow the installation of two canopy shade structures over the outdoor play structures at an existing church/school at 10181 Finch Avenue. Discussion: File No. DIR-2003-09 is a Minor Modification of 33-U-87 to allow the installation of two canopy shade structures over the outdoor play structures at an existing church/school at 10181 Finch Avenue. Recently, new outdoor play structures were installed at the Bethel Lutheran Church and School to replacing aging and unsafe equipment. A large tree that partially shaded the playgrounds was also recently removed by the church when it developed a large crack in the trunk. The tree was deemed a hazard by city staff who authorized its removal. The applicants have requested the installation of permanent shade structures when it discovered that the school kids were burning themselves on the play structures heated by the summer sun. The shade canopies are 40' x 20' x 12' and 30' x 20' x 12' (length, width and height), and is setback 38 feet from the closest residential property. A hipped roof was selected to reduce its visible profile to neighbors. The structures meet the accessory structure setback regulations and will need to comply with city building codes. Action: The Director of Community Development deems the modification minor and approves the two shade canopies as depicted on the site plans and the Custom Canopies, Inc. literature.
