Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes to a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning Commissioner to
appeal the decision within fourteen calendar days.
Application:
File No. DIR-2003-07: Minor Modification of 2-V-65 to allow a single-story, 262 square
foot addition to an existing residence in a planned development. 22285 South De Anza
Circle.
Background:
This cluster subdivision of residences was developed prior to the advent of planned
development zoning. It has a narrow street width approved through the subdivision
process. It has smaller building setbacks than would normally be found in the Rl-7.5
zoning district that were approved through variances. The approved variance (file no. 2-
V -65, see Exhibit A) provides a mechanism for the "City Planner" to consider and
approve minor changes to residences without going through another variance process.
The variance condition of approval states:
" In the event that the applicant shall desire to make any change, alteration or
amendment in the approved Development Plan after they had been approved by the City
Council as a condition to a Variance, a written request and a revised Development Plan
shall be submitted to the City Planner.
if the number of dwelling units is not increased, and the City Planner makes a finding
that the changes are minor and do not affect the general appearance of the area or the
interests of owners of property within or adjoining the Development Area, the City
Planner may certify the change on the revised plan. If such approval is withheld, the
applicant may appeal to the Planning Commission... "
The applicant proposes to fill in an existing porch/entrance area and create a new
entrance and smaller porch to one side. The addition is designed to match existing
building materials and roof pitches. The current building setback of 4 feet to the front
property line and 14 feet to the curb will be maintained.
The property owner states there is no homeowners' association that would be responsible
for design review. A check with neighbors confirms this statement.
Planning staff deems the changes to be minor. The Community Development Director
approves the project with the condition that the new window trim be either painted wood
or stucco-coated wood which is in keeping with the building materials in the
neighborhood.
Action:
The Director of Community Development finds that:
1. the number of dwelling units has not increased, and
2. the residential changes are minor and do not affect the general appearance of
the area or the interests ofthe property owners within or adjacent to the
subject area.
The Director of Community Development approves the modification to the variance for
the residential addition as presented in the plan set titled: " DRAWN BY: MICHEAL S.
HAMLETT, 322 PALM AVE., WATSONVILLE, CA 95076" for "OWNER:
MARSHALL MAPLE, 22285 S. DE ANZA CIR., CUPERTINO, CA 95014," consisting
of four pages labeled 1 through 4 and dated 3/26/03, except as amended by the following
condition of approval
1. The new window trim shall be either painted wood or stucco-coated wood.
The modification is effective July 17,2003. The fourteen calendar day appeal period
will expire on August 1, 2003.
