Report of Director's Decision Regarding a Minor Modification to a single-
family home in a P(Res) zone at 10546 Manzanita Court in the Oak Valley
area.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of
minor changes in a project. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Planning
Commissioner to appeal the decision within fourteen calendar days.
Action Taken
The Director approves the modification, with the following condition:
The pizza oven concrete pad shall be located 5 feet from the property line.
This approval of the modification is effective April 8, 2003. The fourteen calendar day
period will expire on April 22, 2003.
Discussion
The property is in a planned single-family residential development in the Oak Valley area< The
property owner proposes to construct a gazebo/trellis, barbecue island and Jacuzzi in the rear
yard. The gazebo/trellis is located 7.5 feet from the north property line. The trellis is 9 feet 7
inches tall. The barbecue is located 5 feet from the north property line. The location of a
concrete pad for a pizza oven is shown incorrectly in this same areai a condition of approval
requires that it be 5 feet from the property line.
The Jacuzzi is located 7 feet from the south property line and 8 feet from the west or rear
property line. It is 30 inches tall.
The accessory structures conform to the setback requirements of the accessory structure
ordinance, given the condition of approval for the pizza oven location. There are residences on
either side of the proposed structures. These adjacent property owners will be notified of the
proposal; one neighbor has already signed the plans in approval (see plan set). The rear of the
lot backs up to public open space (see Oak Valley plan).
