Chapter 19.132 of the Cupertino Municipal Code allows for administrative ,approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION: The property owner of this single family home in the Oak Valley subdivision proposes to construct an arbor, barbecue and fireplace in the rear yard. Oak Valley is a planned development, so a modification to the use permit (6-U-97) is required for this project. The arbor is located 15 feet from the side property line, which is on a corner (Canyon Oak Way). It is approximately 12 feet in height to the roof ridge. The fireplace chimney is 14.5 feet in height. The roof and chimney will have visual impacts as viewed from Canyon OakW ay. Landscape screening will be required along the property line between the fence and the arbor / fireplace. ACTION: The Director of Community Development approves the project with the following condition: Two 24" box evergreen trees shall be planted between the fence and the arbor/fireplace prior to final inspection.
