Chapter 19.128 of the Cupertino Municipal Code allows for administrative
approval of a use permit, authorizing the use of a site in any zoning district for a
temporary use. The Director reports his decision to the City Council and
Planning Commission in time to allow any Councilmember or Plam1ing
Commissioner to appeal the decision within fourteen calendar days.
Application:
File No. DIR-2005-34: Director's Temporary Use Permit for a temporary event at
the Marriott Courtyard Hotel, 10605 North Wolfe Road.
The applicant, Tyre, Bailey, Roberts & Associates Estate Buyers, is proposing to
purchase secondhand items (antiques) from the public; there are no sales of
items. The event occurs over a six-day period, from January 2 to January 7, 2006.
The hours are 9:00 a.m. to 7 p.m.
The public is notified of this event through newspaper advertising. There are no
signs on the street or at the site. The event is set up in approximately 30 of the
hotel rooms. Approximately 200-300 people a day are expected, or about 25-30
people per hour. No parking problems are expected since the event utilizes 30
rooms that theoretically could generate 30 cars requiring parking.
Action:
In accordance with Chapter 19.128 of the Cupertino Municipal Code, the Director
of Community Development finds
1. The granting of the application will not be detrimental or injurious to
property or improvements in the vicinity, and will not be detrimental to
the public, health, safety, general welfare, or convenience; and

2. The proposed use will be located and conducted in a manner in accord
with the Cupertino General Plan and the purposes of this title.
The Director of Community Development grants a temporary use permit for the
six day event effective January 2 through January 7, 2006. The fourteen calendar
day appeal period will expire on December 22, 2005.

Enclosed is a check for $1,291 to cover the cost of a Temporary Use Permit and the
Environmental Fee for Tyre, Bailey, Roberts & Associates Estate Buyers.
According to our December 2nd conversation, you will use the information sent with the
application for a City of Cupertino Special Event Permit to issue the Temporary Use Permit.
As I explained previously, during the event, Tyre, Bailey, Roberts & Associates Estate Buyers
will purchase secondhand items from the public, but will not sell anything.
