(Modifies 2-U-84) Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND: This residential unit is part of a mixed-use office/residential development located on the corner of Pasadena and Granada A venue. There are four residential units over 4,000 square foot of office space. The original use permit, approved in 1984, limited each unit to two bedrooms, due to the number of parking spaces provided. DISCUSSION: The applicant proposes to convert 182 square feet of office space in unit A3 to a den. According to the ordinance, rooms without closet space (such as the proposed den) are not considered bedrooms. There will also be conditions of approval that prohibit future changes to include new plumbing facilities in the Ioft/ attic area and a deed restriction shall be recorded stating that the den will not be utilized as a bedroom. Also as part of this project, the applicant proposes to fill in an existing opening in the rear porch with windows. Staff has no problem with this change, except that the windows must have a similar pane pattern as the other windows on the south elevation. Another proposed change is to add two new windows to the south elevation serving the den area. A condition of approval will be the submission of privacy planting plan, which identifies the location, species, and canopy diameter of existing and proposed trees and shrubs. New trees or shrubs shall be required on the applicant's property to screen views from second story windows facing any single- family residential property unless a waiver from that neighbor has been obtained. ACTION: The Director approves the application with the following conditions: A deed restriction shall be recorded that states that the den shan not be used as a bedroom, shall not have built-in closets, and that no plumbing facilities shall be added to the den, loft or attic area. The deed restriction form shall be approved by staff and shall be recorded 30 days after approval.
