Subject: Director's Minor Modification, DIR-2005-23, to enclose existing recessed
covered porches on an existing one-story building located at 20400 Mariani
A venue within a P(Commercial, Office, Industrial) zoning district.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION:
The applicant, Apple Computer, proposes to enclose existing recessed covered porches
on an existing one-story building that will allow for additional office space for Apple.
Apple will be occupying the rear half of the building consisting of 47,569 square feet.
The building will accommodate additional corporate administrative offices, including
Apple's corporate procurement and facilities offices, and its marketing and
communications offices, including a photo shoot room, video room and
conierencef training rooms. The other tenant within the building is Dade Behring, a
clinical diagnostics company.
The existing recessed covered porches that Apple is proposing to enclose are located on
the southwesterly side of the building and are not very visible from Mariani Avenue.
They propose to maintain the existing architectural character of the building by
installing a new brown glass storefront system to match the existing storefront system
that will align with the outer wall of the building.
Enclosing the recessed porches will not add to the existing floor area ratio and lot
coverage of the property, since these recessed porches are already considered covered
floor area as they are covered and enclosed on three sides. Most of the recessed porches
do not serve any useful purpose since many of these porches are neither accessible from
the building (no door access) nor from the landscaped area around them. However,
enclosing these spaces will add approximately 1,240 square feet of useable office area
for Apple. There is adequate parking to accommodate the increased office area.

ACTION:
The Director of Community Development deems the modification minor and approves
the minor site improvements.
This approval of the modification is effective September 13, 2005. The fourteen calendar
day appeal period will expire on September 27, 2005.
